Terms of Service

These Terms of Service ("Terms") govern your use of the website and services of HumanSkin (operated by Kerry Marin, "we", "us" or "our"), available at humanskin.ai. By purchasing or using the Service you agree to these Terms.

1. The Service

HumanSkin provides done-for-you management of AI-generated Instagram personas ("models") for clients. Depending on your plan, the Service may include:

  • Creation of an AI model identity and persona document (one-time "Launch" setup);
  • Creation and delivery of AI-generated content packages;
  • Scheduling and publishing of content to the client's connected Instagram professional account;
  • Automated responses to comments and direct messages on that account, generated with AI in the model's voice;
  • Monthly performance reports.

All automation operates exclusively through Meta's official APIs, within the limits and policies Meta establishes.

2. Eligibility

  • You must be at least 18 years old;
  • You must own, or be duly authorized to manage, the Instagram account you connect, and it must be an Instagram professional account (Creator or Business);
  • You must comply with Instagram's Terms of Use and Community Guidelines, and with all laws applicable to you and your audience.

3. Your responsibilities

  • You are the owner and operator of the connected Instagram account and of any external platform (such as fan subscription platforms) you link to. You are responsible for those accounts and for your relationship with your audience;
  • You will not ask us to publish or automate unlawful content, spam, harassment, or content that violates Instagram's policies;
  • You are responsible for any disclosure obligations that apply to you in your jurisdiction (for example, disclosing AI-generated content or automated interactions where required by law);
  • You will keep your contact and billing information current.

4. Content rules

  • All content published or automated on Instagram through the Service is strictly non-explicit. We enforce this rule in our systems and it is not negotiable — it protects your account;
  • All content we deliver is AI-generated and labeled as such. You are responsible for keeping that label where the law of your market requires it (for example, EU AI-transparency rules);
  • Automated conversations follow hard safety rules, including: honesty about being AI when asked directly, no interactions with suspected minors, no requests for personal or financial data, and escalation of sensitive situations to a human operator.

5. Fees and billing

  • Launch is a one-time setup fee. Starter and Pro are monthly subscriptions billed in advance;
  • Purchases made on our website are processed by our merchant of record (Paddle). Purchases made through Fiverr are billed and governed by Fiverr's own terms in addition to these Terms;
  • If a subscription payment fails, we will notify you; if it remains unpaid after 7 days, the Service for your account is paused until payment is resolved;
  • Fees are non-refundable once the corresponding work (setup or monthly operation) has begun, except where required by law or stated otherwise at checkout.

6. Deliverables and revisions

  • Each monthly content calendar includes one revision round. Additional revision rounds may be offered as paid add-ons;
  • Deliverable quantities are those described in your plan at the time of purchase;
  • Delivery timelines are estimates and may vary with third-party review processes (e.g. Meta app permissions).

7. Intellectual property

  • Upon full payment, you own the delivered model identity and content packages for use in your own channels and platforms;
  • We retain all rights to our software, systems, prompts and know-how;
  • You grant us the license needed to store, process and publish your content solely to provide the Service;
  • We may showcase non-explicit samples of work in our portfolio unless you opt out in writing.

8. Term, cancellation and disconnection

  • Monthly plans renew automatically until cancelled. You may cancel at any time; the Service continues until the end of the paid period;
  • You may disconnect your Instagram account at any time via the Disconnect page, Instagram's own settings, or (once activated) your client portal. Disconnecting stops all automation immediately and deletes stored access tokens, as described in our Privacy Policy;
  • We may suspend or terminate the Service for breach of these Terms, non-payment, or where continuing would put your account or our platform standing at risk. Where reasonable, we will notify you first.

9. Third-party platforms

The Service depends on third-party platforms — in particular Meta / Instagram — whose APIs, policies and review processes are outside our control. We are not responsible for actions taken by those platforms (including feature changes, rate limits, content removal or account restrictions), although we design the Service conservatively to minimize such risks. HumanSkin is not affiliated with, endorsed by or sponsored by Meta Platforms, Inc.

10. Disclaimers

  • The Service is provided "as is" and "as available";
  • We do not guarantee any specific results — follower growth, engagement, subscriber conversions or revenue depend on many factors outside our control;
  • AI-generated content and replies, while carefully constrained, may occasionally be imperfect. We provide monitoring, escalation and a pause control to manage this.

11. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability arising out of or related to the Service is limited to the amounts you paid us in the three (3) months preceding the claim. We are not liable for indirect, incidental, special or consequential damages, or for loss of profits, revenue or data.

12. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your breach of these Terms, your use of the deliverables on third-party platforms, or your violation of applicable law or third-party rights.

13. Governing law

These Terms are governed by the laws of Chile, without regard to conflict-of-law rules. Disputes will be resolved in the competent courts of Chile, unless mandatory consumer law in your country provides otherwise.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified to active clients by email at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance.
